1. Agreement to Terms

By purchasing, downloading, installing, or using DriveSync ("the Software"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not purchase or use our Software.

2. Product Description

DriveSync is a premade digital software product for macOS that scans external drives and identifies duplicate files. It is delivered as a downloadable application. We do not offer custom development, 1:1 consulting services, or customized products.

3. License Grant

Upon purchase, you receive a single-user, non-exclusive, non-transferable license to install and use the Software on up to two (2) devices that you personally own or control.

4. License Activation

Each license requires activation via our license server. Activation links your license key to a unique machine fingerprint. If you need to transfer your license to a new device, contact support@drivesync.app.

Maximum activations: 2 devices per license.

5. Payment & Pricing

All payments are processed securely through our payment provider (Lemon Squeezy). Prices are listed in USD and are subject to change. You agree to pay all fees associated with your purchase.

6. Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with DriveSync within 14 days, contact us at support@drivesync.app for a full refund. After 14 days, all sales are final.

7. Software Updates

Your license includes all minor updates and bug fixes. Major version upgrades may require a separate purchase or upgrade fee, which will be communicated in advance.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. DRIVESYNC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Use at your own risk: While DriveSync is designed to help you safely identify and remove duplicate files, you are solely responsible for ensuring you do not delete files you need. Always review deletion selections carefully and maintain backups of important data.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVESYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR LOSS OF PROFITS.

Our total liability shall not exceed the amount you paid for your license.

10. Termination

We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the Software and uninstall all copies from your devices.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Software after changes are posted constitutes acceptance of the revised Terms.
